Booking conditions

WHEN YOU BOOK WITH ROOTS OF RHYTHM TRAVEL WE WANT YOU TO BE SATISFIED WITH YOUR HOLIDAY. PLEASE READ CAREFULLY THE BOOKING CONDITIONS AND GENERAL INFORMATION CONTAINED ON THIS PAGE. THESE ARE THE TERMS OF A CONTRACT WHICH SET OUT THE RESPONSIBIITES OF US, ROOTS OF RHYTHM TRAVEL, AND YOU, THE CUSTOMER.

RESERVATIONS
At the time of confirming your reservation you should complete a booking form and send it to Roots of Rhythm Travel with a deposit of £100 per person for fly-drive itineraries. Activity holidays, coach tours and rail tour deposits vary, therefore we would ask you to confirm the deposit with your consultant. No contract shall exist until receipt of a signed booking form and the appropriate deposits have been received by Roots of Rhythm Travel. NB: If a booking is made within ten weeks of travel the full amount of the holiday must be paid.

PAYMENTS AND BALANCES
All balances must be received by Roots of Rhythm Travel no later than ten weeks prior to your departure date. If Roots of Rhythm Travel have not received the balance due on the date shown on your confirmation invoice, your holiday will be cancelled. We do not in any circumstances send reminders. Should we have to cancel your holiday because the payment has not been received on the date shown you will be liable to the cancellation charges shown in paragraph 3.

CANCELLATIONS BY YOU
All cancellations are subject to the fees shown below. If cancellations of the holiday booked is made after receipt of the travel documents, no refunds can be made unless all tickets and other documentation are returned to Roots of Rhythm Travel. Insurance premiums will not be refunded.

AMENDMENTS BY YOU
If you decide to alter any aspects of your holiday once the booking form has been received by Roots of Rhythm Travel, providing notification is received more than 10 weeks prior to departure, a £25 per person (maximum £100 per booking) administration fee will be charged per change. Any name changes or alterations made within 10 weeks of departure will be treated as a cancellation.

IF ROOTS OF RHYTHM TRAVEL CHANGES YOUR HOLIDAY
On occasions it may be necessary to amend the holiday arrangements that you have selected and we reserve the right to do so at any time. Most of these changes are very minor but where they are material we undertake to inform you as soon as reasonably possible. Material change is one that we make to your holiday arrangements before departure that involves changing your airport of departure , or a difference of more than 12 hours in your departure time or a change in your accommodations. You then have a choice of either (a) accepting the changed arrangements as notified to you; (b) purchasing another holiday from Roots of Rhythm Travel or (c) cancelling your holiday. If you choose (a) or (b) we will pay you compensation on the scale set out. If you choose (c) we will refund you all the monies you have paid us plus compensation as set out below. However, in no case will we pay compensation if the change is due to an event set out under IMPORTANT NOTE below.

IMPORTANT NOTE
Compensation payments do not apply to changes caused by reason of war or threats of war, riots, civil strife, terrorist activity, industrial disputes, natural and nuclear disasters, fire, epidemics or health risk, technical problems to transport, closure or congestion of airports, cancellations or changes of schedules by scheduled airlines or similar events beyond our control.

IF ROOTS OF RHYTHM TRAVEL CANCELS YOUR HOLIDAY
Although it is unlikely, Roots of Rhythm Travel reserves the right in exceptional circumstances to cancel your holiday. In this event we will inform you as soon as possible and you will be offered an alternative holiday of at least comparable standard if available, or a refund of all monies paid. In no case except for reasons as set out as above under IMPORTANT NOTE will your holiday be cancelled less than ten weeks prior to your scheduled departure date. We reserve the right to cancel your holiday if your balance has not been received on the date due.

FLIGHT SCHEDULES AND DELAYS
Planned flight departure times and aircraft types are provided to us in good faith but are given for guidance only. Flight departure times can be affected by several factors including, but not limited to air traffic control and weather conditions. Roots of Rhythm Travel does not accept liability, or pay compensation for (or consequence of) transatlantic or domestic North American flight delays, nor for changes in aircraft type or airline. The airline will assist in cases of delay (except in cases of force majeure) by providing seats on the next available flight and overnight accommodation where necessary.

OUR LIABILITY TO YOU
Roots of Rhythm Travel offers total financial security as a fully bonded member of ATOL, ABTA and IATA. We also accept responsibility for those arrangements for your holiday which are wholly within our control and therefore accept liability to clients for any negligent act or omission of our employees or agents. We have taken all reasonable steps to ensure that the appropriate arrangements will be made for the parts of your holiday which may compromise travel, catering and accommodation services and to ascertain the veracity of the suppliers of these services. We have no direct control over the provision of such services to you by suppliers and do not have, nor accept, any liability for the actions or omissions of them or any persons employed by them who are not our servants or agents

If you should have a genuine claim as a result of the way in which services have been provided or any failure to provide them, we will give you reasonable assistance in pursuing your claim against the responsible supplier. Any dispute which can not be amicably settled may be referred to arbitration under a special scheme devised by arrangements with the Association of British Travel Agents and administrators.

Travel Tickets and Vouchers are valid for the advertised period of the holiday and for the route specified and no refund whatsoever will be made for lost, mislaid, unused, unendorsed or expired tickets, coupons or vouchers. Refunds will not be made if tickets are not used over the route for which they are valid.

BROCHURE ACCURACY
Every effort has been made to ensure tha accuracy of descriptions and information in our brochure and other printed and online material however we are not always able to control all the components of the holiday arrangements and it is possible that an advertised facility may be withdrawn or changed. Roots of Rhythm Travel will advise you as soon as we become aware of a major change, but we cannot accept liability for the loss of an advertised facility.
